Terms of use

The London young artist website (the "Site") is a platform designed to promote young artists and their work, owned and operated by London young artist Ltd. ("London young artist," “LTA" "we," or "us"). By accessing or using the Site, you agree to comply with and be bound by the following terms and conditions, which constitute an agreement (the "Agreement") between you and London young artist governing your use of the Site. Please carefully review these terms and conditions before using the Site.

By accessing or using the Site and/or submitting artwork or other content, you represent and warrant that you have read, understand, have the legal capacity, and agree to be bound by these terms and conditions.

London young artist Ltd. reserves the right, at its sole discretion, to modify, change, or otherwise revise these terms and conditions at any time. The most recent version of the terms and conditions will be posted on the Site, along with a date indicating when the changes were made. Any modifications will be effective immediately upon posting. We encourage you to check for updates each time you access or use the Site to stay informed of any changes. Your continued use of the Site after the posting of modifications will constitute your agreement to be bound by the revised terms and conditions.

Consent to Communications

By providing personal and contact information during registration to use the Site, you acknowledge that Londonyoungartist Ltd. may send you emails or other communications relating to your use of the Site, potential violations of the terms and conditions, and promotional materials related to London young artist. If such communication contains an offer or solicitation, Londonyoungartist will provide instructions for opting out. London young artist reserves the right to communicate with you or your representative through email or other means. We assure you that all personal information provided will be protected in accordance with our Privacy Policy.

LYA’s Obligations

Londonyoungartist Ltd. hosts a blog on the Site, but is not obligated to monitor any content provided by third-party users. We explicitly disclaim any responsibility for the accuracy or appropriateness of any content posted by unrelated third-party users on the blog. We reserve the right to remove any post that we deem inappropriate, fraudulent, illegal, profane, objectionable, or that may infringe on intellectual property rights in our sole discretion. You acknowledge and agree that Londonyoungartist shall not be held liable for any action or inaction regarding any data, material, content, or input posted or removed by us on the Site.

User Conduct

In using the Site, you agree not to engage in any conduct that violates applicable federal, state, local, or international laws, or that serves any unlawful purpose. You are prohibited from posting any materials on the Site that are inappropriate or infringe on the intellectual property rights of others. By submitting any content or information, you represent and warrant that you have all necessary rights to do so.

London young artist Ltd. reserves the right to revoke your access to and use of the Site if, in our sole discretion, your actions violate any of the following rules:

  • You are prohibited from engaging in activity that harms or disrupts the Site or our computer systems and network.

  • You may not interfere with any other person's or organisations use of the Site.

  • You may not misrepresent your identity or impersonate another person.

  • You are prohibited from attempting to gain unauthorised access to any accounts, computers, or networks related to the Site.

  • You may not submit any content protected by intellectual property laws unless you have obtained all necessary consents or own or control the rights to such material.

  • You may not attempt to modify, translate, adapt, edit, copy, decompile, disassemble, or reverse engineer any software provided by London young artist Ltd. in connection with the Site.

Copyright

Londonyoungartist Ltd. strictly prohibits the illegal transmission of copyrighted material through the Site and will take action upon receiving notice from content owners to prevent such transmission.

If you believe that your copyrighted work has been copied in a way that constitutes infringement, please provide us with the following written information:

 

  • Your electronic or physical signature, or that of a person authorised to act on behalf of the owner of the copyright interest;

  • A description of the copyrighted work that you claim has been infringed;

  • Information about where the infringing material is located on the Site;

  • Your contact information, including your address, telephone number, and email address;

  • A statement from you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

  • A statement made under penalty of perjury that the above information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner's behalf.

No Warranties

By using the Site, you acknowledge and agree that London young artist Ltd. shall not be held liable for any technical errors or loss of files.

London young artist Ltd. aims to transfer user data accurately and reliably through the Site, but errors may occur. THE SITE AND ITS SERVICES ARE PROVIDED "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE," AND YOU ASSUME ALL RISKS RELATED TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT. TO THE EXTENT PERMITTED BY APPLICABLE LAW, London young artist Ltd. AND ITS OFFICERS, DIRECTORS, AND AFFILIATES DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, STATUTORY OR IMPLIED, INCLUDING BUT NOT LIMITED TO (1) WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, (2) WARRANTIES OR CONDITIONS ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, AND (3) WARRANTIES OR CONDITIONS THAT ACCESS TO OR USE OF THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify, defend, and hold harmless Londonyoungartist Ltd., its officers, directors, and affiliates, from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from your use of the Site or any violation of this Agreement by you.

Others

If any part of these terms and conditions is deemed invalid or unenforceable under applicable law, including but not limited to the warranty disclaimers and liability limitations set forth above, such provision will be replaced by a valid and enforceable provision that closely reflects the intent of the original provision, and the remainder of the agreement will remain in effect. Any notice given in electronic form and a printed version of these terms and conditions will be admissible in judicial or administrative proceedings to the same extent as other business documents and records originally created and maintained in printed form.

London young artist Ltd. reserves the right to assign this Agreement, in whole or in part, with or without notice to you. You are not allowed to assign this contract or any part of it to any other party, and any attempt to do so will be considered void.

The failure of London young artist Ltd. to exercise or enforce any right or provision of these terms and conditions shall not be deemed a waiver of such right or provision.

Your use of the Site does not create any agency, partnership, joint venture, or employment relationship between you and London young artist Ltd.

Both parties agree that these Terms of Use represent the complete and exclusive understanding between them.
